توضح هذه السياسة كيفية جمع واستخدام ومعالجة وحفظ ومشاركة البيانات عند استخدام تطبيق أو منصة Smart Pen أو أي خدمة أو أداة أو ميزة مرتبطة بها، بما في ذلك الأدوات التي تعتمد على الذكاء الاصطناعي.
باستخدامك أو تنزيلك أو تثبيتك أو دخولك أو إنشاء حساب أو الاستمرار في استخدام Smart Pen، فإنك تقر بأنك أتيحت لك فرصة الاطلاع على هذه السياسة وشروط الاستخدام، وأنك توافق على الالتزام بها إلى أقصى حد يسمح به القانون المطبق عليك.
عدم قراءة هذه السياسة أو شروط الاستخدام، أو عدم فهمها، أو استخدام التطبيق بلغة لا تتقنها، لا يُعفيك من مسؤوليتك عن استخدام الخدمة أو من الالتزامات الناشئة عن استخدامك لها، إلى أقصى حد يسمح به القانون. تقع على المستخدم مسؤولية طلب الترجمة أو التوضيح أو التوقف عن استخدام الخدمة إذا لم يفهم الشروط.
إذا كان القانون المطبق في بلد المستخدم يتطلب موافقة صريحة منفصلة أو إشعارًا إضافيًا أو حقًا لا يمكن التنازل عنه، فإن تلك المتطلبات تبقى سارية ولا يُقصد بهذه السياسة استبعادها.
قد نقوم بجمع أو معالجة البيانات اللازمة لتقديم الخدمة، ومنها:

- النصوص والأسئلة والتعليمات والمطالبات التي يرسلها المستخدم.

- المحتوى الذي يتم إنشاؤه أو تعديله أو تحليله باستخدام الأدوات المتاحة.
- بيانات الرصيد والمشتريات ومعرّفات المعاملات.
- بيانات تقنية وتشغيلية مرتبطة بالأمان، والأداء، ومنع إساءة الاستخدام، وتشخيص الأعطال.
- بيانات الدعم الفني والتواصل.
لا يطلب Smart Pen بيانات بطاقتك البنكية ولا يخزنها مباشرة إذا كانت عملية الدفع تتم من خلال متجر التطبيقات أو مزود دفع مستقل. وتخضع بيانات الدفع في هذه الحالة لسياسات الجهة التي تعالج عملية الدفع.
قد نستخدم البيانات من أجل:
- إنشاء الحساب وإدارته.
- تشغيل الأدوات والخدمات.
- تنفيذ طلبات الذكاء الاصطناعي ومعالجة الملفات والمحتوى.
- حفظ المشاريع أو النتائج أو الأرصدة عند توفر هذه الخصائص.
- التحقق من المشتريات.
- حماية الخدمة والمستخدمين.
- منع الاحتيال وإساءة الاستخدام.
- اكتشاف الأعطال وتحسين الأداء.
- الرد على طلبات الدعم.
- الامتثال للمتطلبات القانونية والتنظيمية الملزمة.
المستخدم وحده مسؤول عن جميع المواد والمحتوى والطلبات والتعليمات والصور والنصوص والصوت والفيديو والملفات والمستندات والبيانات التي يرفعها أو يدخلها أو يرسلها أو يصورها أو يسجلها أو يستخدمها داخل Smart Pen.
ويقر المستخدم بأنه يمتلك جميع الحقوق أو التراخيص أو الأذونات أو الموافقات اللازمة لاستخدام أي محتوى يرفعه أو يعالجه أو يستخدمه داخل التطبيق.
لا يعني قبول Smart Pen لملف أو صورة أو طلب أن المنصة قد تحققت من ملكيته أو مشروعيته أو صحة استخدامه.
Smart Pen غير مسؤول عن تحديد ما إذا كان المحتوى المرفوع أو المستخدم أو الناتج ينتهك حقوق النشر أو العلامات التجارية أو الخصوصية أو حقوق الصورة أو الملكية الفكرية أو السرية أو أي حقوق أخرى للغير.
يتحمل المستخدم وحده المسؤولية عن أي محتوى أو نتيجة يتم إنشاؤها أو تعديلها أو تحليلها بواسطة Smart Pen.
وقد تكون النتائج:
- غير دقيقة أو غير مكتملة.
- مشابهة لمحتوى موجود مسبقًا.
- غير مناسبة لغرض معين.
- محتاجة إلى مراجعة بشرية.
- غير مؤهلة لاستخدام قانوني أو تجاري معين.
- متأثرة بقيود أو سياسات مزودي النماذج الخارجيين.
يجب على المستخدم مراجعة النتائج والتحقق منها قبل تنزيلها أو نشرها أو مشاركتها أو بيعها أو الاعتماد عليها أو استخدامها لأي غرض.
أي استخدام أو نشر أو مشاركة أو تعديل أو بيع أو إعادة توزيع أو اعتماد على المحتوى الناتج يتم على مسؤولية المستخدم وحده.
المستخدم مسؤول عن التأكد من أن لديه الحق في استخدام:
- الصور.
- صور الأشخاص ووجوههم.
- الأصوات.
- الشعارات.
- العلامات التجارية.
- النصوص.
- الكتب.
- المستندات.
- التصاميم.
- الموسيقى.
- الفيديو.
- المواد التعليمية.
- البيانات الشخصية.
- وأي محتوى آخر.
ولا تتحمل Smart Pen مسؤولية أي مطالبة أو نزاع أو شكوى أو خسارة أو ضرر ينتج عن قيام المستخدم برفع أو إنشاء أو استخدام أو مشاركة محتوى لا يملك حق استخدامه، إلى أقصى حد يسمح به القانون.
يجب على المستخدم عدم إدخال أو رفع أو معالجة بيانات شخصية أو صور أو تسجيلات أو ملفات تخص أشخاصًا آخرين إلا إذا كان لديه أساس قانوني أو موافقة أو حق يسمح له بذلك.
المستخدم وحده مسؤول عن الحصول على أي موافقات مطلوبة.
قد تستخدم Smart Pen مزودي خدمات خارجيين، بما في ذلك مزودو:
- الذكاء الاصطناعي.
- الاستضافة.
- قواعد البيانات.
- التخزين.
- التحقق والأمان.
- المدفوعات ومتاجر التطبيقات.
- التحليلات والخدمات التقنية.
وقد يلزم إرسال بعض البيانات أو المحتوى إلى تلك الجهات لتنفيذ طلب المستخدم أو تشغيل الخدمة.
وتخضع معالجة البيانات بواسطة تلك الجهات إلى شروطها وسياساتها وترتيباتها القانونية ذات الصلة.
قد تتم معالجة أو تخزين البيانات في دول مختلفة عن دولة إقامة المستخدم، بحسب مكان وجود البنية التحتية أو مزودي الخدمات.
ويتم التعامل مع هذا النقل وفق المتطلبات القانونية المطبقة حيثما تكون واجبة.
قد نحتفظ بالبيانات للمدة اللازمة لتقديم الخدمة، وتشغيل الحساب، وحماية المنصة، ومنع الاحتيال، وحل النزاعات، وتنفيذ الالتزامات القانونية.
قد تختلف مدة الاحتفاظ بحسب نوع البيانات والغرض من استخدامها.
قد تتوفر للمستخدم إمكانية حذف الحساب من داخل التطبيق أو من خلال وسائل الدعم المتاحة.
قد يؤدي حذف الحساب إلى فقدان البيانات أو المشاريع أو الرصيد أو المحتوى المرتبط بالحساب، وفق خصائص الخدمة ومتطلبات القانون.
قد تظل بعض السجلات محفوظة إذا كان الاحتفاظ بها مطلوبًا قانونًا أو ضروريًا لأغراض منع الاحتيال أو تسوية النزاعات أو حماية الحقوق.
قد يطلب التطبيق أذونات، مثل:
- الكاميرا.
- الصور.
- الميكروفون.
- الملفات أو التخزين.
- الإشعارات.
تستخدم هذه الأذونات لتشغيل المزايا التي يختار المستخدم استخدامها.
نتخذ تدابير تقنية وتنظيمية معقولة لحماية البيانات.
ومع ذلك، لا يمكن ضمان أن أي نظام إلكتروني أو خدمة عبر الإنترنت آمنة بنسبة 100%.
إلى أقصى حد يسمح به القانون، لا تضمن Smart Pen عدم وقوع أعطال أو هجمات أو اختراقات أو فقدان بيانات ناتج عن عوامل خارجة عن السيطرة المعقولة.
لا تبيع Smart Pen البيانات الشخصية للمستخدمين مقابل المال كجزء من نموذج تشغيلها العادي، ما لم يتم توضيح خلاف ذلك والحصول على الموافقات المطلوبة قانونًا.

This Privacy Policy explains how Smart Pen collects, uses, processes, stores, and shares data when you access or use the Smart Pen application, platform, services, features, and tools, including artificial-intelligence-powered features.
By downloading, installing, accessing, creating an account, or continuing to use Smart Pen, you acknowledge that you have been given the opportunity to review this Privacy Policy and the Terms of Use and agree to be bound by them to the maximum extent permitted by the laws applicable to you.
Failure to read this Privacy Policy or the Terms of Use, failure to understand them, or use of the application in a language you do not understand does not, to the maximum extent permitted by applicable law, excuse you from responsibility for your use of the service or from obligations arising from that use. It is your responsibility to obtain a translation or clarification or to stop using the service if you do not understand the terms.
Where the laws applicable in a user's country require separate affirmative consent, additional notices, or rights that cannot legally be waived, those requirements remain applicable and nothing in this Policy is intended to exclude them.
We may collect or process information necessary to provide the service, including:
- Account information, such as name, email address, and login information.
- Prompts, instructions, questions, and text submitted by users.
- Images, files, documents, audio, video, and other content uploaded by users.
- Content generated, modified, analyzed, or processed through the service.

Smart Pen does not directly request or store payment-card information where payment is processed by an app store or independent payment provider. Such payment data is subject to the policies of the entity processing the payment.

- Operate the service and its features.
- Process AI requests and user files.
- Save projects, results, or balances where such features are available.
- Verify purchases.
- Protect the service and its users.
- Prevent fraud and misuse.

You are solely responsible for all content, materials, requests, prompts, instructions, images, text, audio, video, documents, files, and data that you upload, submit, record, capture, or otherwise use through Smart Pen.
You represent that you have all rights, licenses, permissions, and consents necessary to use any content submitted to or processed through the service.
Technical acceptance of a file, image, or request by Smart Pen does not mean that Smart Pen has verified ownership, legality, or authorization.
Smart Pen is not responsible for determining whether uploaded, processed, or generated content infringes copyright, trademark, privacy, publicity, intellectual-property, confidentiality, or other third-party rights.
You are solely responsible for any content or output generated, modified, analyzed, or processed through Smart Pen.
AI-generated outputs may:
- Be inaccurate or incomplete.
- Resemble pre-existing content.
- Be unsuitable for a particular purpose.
- Require human review.
- Be unsuitable for a particular legal or commercial use.
- Be affected by limitations or policies of third-party model providers.
You must review and verify outputs before downloading, publishing, sharing, selling, relying on, or otherwise using them.
Any use, publication, sharing, modification, sale, redistribution, or reliance on generated content is undertaken at your own responsibility.
You are responsible for ensuring that you have the right to use:
- Images.
- Faces and likenesses.
- Voices.
- Logos.
- Trademarks.
- Text.
- Books.
- Documents.
- Designs.
- Music.
- Video.
- Educational materials.
- Personal data.
- Any other content.
To the maximum extent permitted by applicable law, Smart Pen is not responsible for any claim, dispute, complaint, loss, or damage resulting from a user's upload, creation, use, or distribution of content that the user was not entitled to use.
You must not upload, submit, or process personal data, images, recordings, or files belonging to another person unless you have a lawful basis, permission, or other right to do so.
You are solely responsible for obtaining any required consent.
Smart Pen may use third-party providers, including providers of:
- Artificial intelligence.
- Hosting.
- Databases.
- Storage.
- Verification and security.
- Payments and app-store services.
- Analytics and technical infrastructure.
Some content or data may need to be transmitted to such providers in order to perform your request or operate the service.
Processing by those providers may also be subject to their own terms, privacy policies, and legal arrangements.
Data may be processed or stored in countries other than the user's country of residence depending on the location of infrastructure and service providers.
Such transfers are handled in accordance with applicable legal requirements where required.
We may retain information for as long as reasonably necessary to provide the service, operate accounts, protect the platform, prevent fraud, resolve disputes, and comply with legal obligations.
Retention periods may vary depending on the type of data and purpose of processing.
Users may be provided with account-deletion options through the application or available support channels.
Deleting an account may result in loss of data, projects, balances, or content associated with that account, subject to service functionality and applicable law.
Certain records may be retained where legally required or reasonably necessary to prevent fraud, resolve disputes, or protect legal rights.
The application may request access to:
- Camera.
- Photos.
- Microphone.
- Files or storage.
- Notifications.
These permissions are used to operate features selected by the user.

However, no electronic system or online service can be guaranteed to be 100% secure.
To the maximum extent permitted by applicable law, Smart Pen does not guarantee that outages, cyberattacks, unauthorized access, or data loss caused by events beyond its reasonable control will never occur.
Smart Pen does not sell users' personal information for money as part of its ordinary operating model unless otherwise disclosed and any legally required consent is obtained.
Depending on the law applicable to you, you may have rights regarding your personal information, including rights of access, correction, deletion, objection, or withdrawal of consent where provided by law.
Nothing in this Policy is intended to limit any right that cannot legally be waived.
If a user is below the age required by applicable law to consent to data processing or use of the service, parental or guardian consent must be obtained where required.
