تنظم هذه الشروط استخدام تطبيق ومنصة Smart Pen App وجميع المواقع والخدمات والأدوات والميزات المرتبطة بها.
باستخدامك Smart Pen App أو تنزيله أو تثبيته أو الدخول إليه أو إنشاء حساب أو استخدام أي أداة أو إرسال أي طلب أو الاستمرار في استخدام الخدمة، فإنك تقر بأنك أتيحت لك فرصة قراءة هذه الشروط وأنك توافق على الالتزام بها إلى أقصى حد يسمح به القانون المطبق عليك.
عدم قراءتك لهذه الشروط، أو عدم فهمك لها، أو تجاهلك لها، أو استخدام التطبيق بلغة لا تفهمها لا يعفيك، إلى أقصى حد يسمح به القانون، من مسؤوليتك عن استخدامك للخدمة أو من الالتزامات والنتائج المترتبة على ذلك.
تقع على المستخدم مسؤولية قراءة الشروط وطلب ترجمتها أو توضيحها قبل استخدام الخدمة إذا لم يفهمها.
إذا كان القانون المطبق في بلد المستخدم يتطلب موافقة صريحة منفصلة أو يقرر حقوقًا إلزامية لا يمكن التنازل عنها، فإن تلك المتطلبات والحقوق تبقى سارية.
يعتبر تنزيل أو تثبيت أو دخول أو استخدام Smart Pen App أو إنشاء حساب أو الاستمرار في استخدامه قبولًا لهذه الشروط وسياسة الخصوصية، إلى أقصى حد يسمح به القانون.
إذا لم توافق على هذه الشروط، يجب عليك عدم استخدام الخدمة.
Smart Pen App منصة تقنية توفر أدوات وخدمات رقمية، وقد تشمل إنشاء أو تحليل أو تعديل أو معالجة النصوص والصور والصوت والفيديو والملفات والمستندات باستخدام تقنيات الذكاء الاصطناعي.
Smart Pen App يوفر أدوات تقنية ولا يعتبر ناشرًا أو مؤلفًا أو مالكًا أو متبنيًا للمحتوى الذي يدخله المستخدم أو يطلب إنشاءه أو يختار استخدامه.
المستخدم وحده مسؤول مسؤولية كاملة عن:
- جميع طلباته ومدخلاته.
- الصور والنصوص والصوت والفيديو والملفات التي يرفعها.
- أي بيانات أو محتوى يخص أشخاصًا آخرين.
- جميع النتائج التي يختار إنشاءها.
- كل محتوى يقوم بتنزيله أو حفظه أو تعديله.
- كل محتوى يقوم بمشاركته أو نشره أو بيعه أو استخدامه تجاريًا.
- أي قرار يتخذه اعتمادًا على نتيجة تم إنشاؤها من خلال الخدمة.
استخدام أداة تابعة لـ Smart Pen App لإنشاء المحتوى لا ينقل مسؤولية المستخدم إلى Smart Pen App.
يقر المستخدم ويضمن أنه يمتلك جميع الحقوق والتراخيص والأذونات والموافقات اللازمة لأي محتوى يقوم برفعه أو إدخاله أو معالجته داخل Smart Pen App.
يشمل ذلك، دون حصر:
- الصور.
- الوجوه وصور الأشخاص.
- الأصوات.
- الشعارات.
- العلامات التجارية.
- الكتب.
- النصوص.
- الموسيقى.
- الفيديو.
- المستندات.
- التصاميم.
- البيانات الشخصية.
- المواد المحمية بحقوق الملكية الفكرية.
لا تتحمل Smart Pen App مسؤولية التحقق مسبقًا من ملكية المستخدم لهذه المواد.
قد تنتج أنظمة الذكاء الاصطناعي معلومات أو محتوى:
- غير دقيق.
- غير كامل.
- غير متوقع.
- مشابهًا لمحتوى آخر.
- غير مناسب لبعض الاستخدامات.
- غير صالح للاستخدام التجاري أو القانوني في بعض الحالات.
Smart Pen App لا يضمن أن أي نتيجة:
- دقيقة بنسبة 100%.
- أصلية أو فريدة بشكل مطلق.
- خالية من مطالبات أطراف أخرى.
- مؤهلة للحماية بحقوق الملكية الفكرية.
- صالحة لأي استخدام تجاري أو قانوني أو مهني.
- مطابقة تمامًا لتوقع المستخدم.
المستخدم مسؤول عن مراجعة كل نتيجة قبل استخدامها.
إلى أقصى حد يسمح به القانون، لا تتحمل Smart Pen App المسؤولية عن:
- إساءة استخدام الخدمة.
- استخدام المستخدم للنتائج بطريقة غير قانونية.
- انتهاك حقوق الملكية الفكرية.
- انتهاك الخصوصية أو حقوق الصورة أو الصوت.
- انتحال الهوية.
- المحتوى المضلل أو المزيف.
- نشر محتوى دون موافقة صاحبه.
- الخسائر الناتجة عن اعتماد المستخدم على مخرجات الذكاء الاصطناعي.
- أي نزاع بين المستخدم وطرف ثالث بسبب المحتوى.
- قرارات تجارية أو تعليمية أو مالية أو قانونية أو صحية أو مهنية اتخذها المستخدم اعتمادًا على النتائج.
يحظر استخدام Smart Pen App في أي نشاط:
- غير قانوني.
- احتيالي.
- ينتهك حقوق الآخرين.
- يتضمن سرقة ملكية فكرية.
- ينتهك خصوصية الآخرين.
- يتضمن انتحال شخصية أو تضليلًا ضارًا.
- يتضمن ابتزازًا أو تهديدًا أو تحرشًا.
- يتضمن استغلالًا غير مشروع.
- يحاول اختراق أو تعطيل أو إساءة استخدام التطبيق.
- يتجاوز القيود الأمنية.
- يستخدم حسابات أو وسائل دفع دون تصريح.
- يخالف شروط متاجر التطبيقات أو مزودي الخدمات.
- يخالف أي قانون أو لائحة ملزمة تطبق على المستخدم.
يجوز لـ Smart Pen App، إلى أقصى حد يسمح به القانون:
- رفض تنفيذ طلب.
- إزالة أو حجب محتوى.
- تعليق حساب.
- تقييد ميزة.
- إيقاف خدمة.
- إنهاء حساب.
- اتخاذ إجراءات أمنية.
- التعاون مع الجهات المختصة عند وجود التزام قانوني بذلك.
تقدم Smart Pen App والخدمات والمخرجات "كما هي" و"حسب التوفر".
إلى أقصى حد يسمح به القانون، لا تقدم Smart Pen App أي ضمان صريح أو ضمني بأن:
- الخدمة ستعمل دون توقف.
- الخدمة ستكون خالية تمامًا من الأخطاء.
- النتائج ستكون دقيقة.
- النتائج ستكون مناسبة لغرض معين.
- جميع الخصائص ستظل متاحة دائمًا.
- أي نموذج أو مزود خارجي سيبقى متاحًا.
- أي نتيجة ستكون قابلة للاستخدام قانونيًا أو تجاريًا في جميع الدول.
تعتمد بعض الوظائف على مزودين خارجيين.
قد تتوقف بعض الخدمات بسبب:
- انقطاع الشبكات.
- تعطل مزود خارجي.
- توقف واجهة برمجية.
- تغييرات تقنية.
- صيانة.
- تغييرات في سياسات المتاجر.
- تغييرات في النماذج أو مقدمي خدمات الذكاء الاصطناعي.
إلى أقصى حد يسمح به القانون، لا تتحمل Smart Pen App مسؤولية الأعطال أو الخسائر الناتجة مباشرة عن أطراف خارجة عن سيطرتها المعقولة.
لا تعتبر نتائج Smart Pen App بديلًا عن استشارة مهنية مؤهلة.
لا يجوز اعتبار النتائج وحدها:
- استشارة طبية.
- استشارة قانونية.
- استشارة مالية.
- استشارة هندسية.
- استشارة مهنية مرخصة.
- قرارًا أكاديميًا أو تعليميًا رسميًا.
المستخدم مسؤول عن التحقق من أي معلومة مهمة من مختص مؤهل.
المستخدم مسؤول عن الالتزام بسياسات المدرسة أو الجامعة أو المؤسسة التعليمية.
ولا تتحمل Smart Pen App مسؤولية استخدام المستخدم للخدمة في الغش أو الانتحال أو مخالفة قواعد المؤسسة التعليمية.
المستخدم مسؤول عن:
- حماية بيانات تسجيل الدخول.
- الأنشطة التي تتم من حسابه.
- عدم مشاركة الحساب بصورة مخالفة.
- إبلاغ الدعم عند الاشتباه في استخدام غير مصرح به.
قد تتم المشتريات من خلال Apple أو Google أو مزودي دفع آخرين.
تخضع بعض جوانب الدفع والإلغاء والاسترداد لسياسات الجهة التي عالجت عملية الدفع، إضافة إلى القانون المطبق.
قد يتم خصم رصيد أو نقاط عند بدء تنفيذ طلب وفق آلية الخدمة.
لا يضمن تكرار نفس الطلب الحصول على نفس النتيجة.
لا تمنح Smart Pen App للمستخدم ضمانًا بأن كل نتيجة تم إنشاؤها ستمنحه حقوق ملكية فكرية حصرية.
قد يحصل مستخدمون مختلفون على نتائج متشابهة.
ويتحمل المستخدم مسؤولية التحقق من حقوق الاستخدام المطلوبة قبل الاستغلال التجاري أو النشر.
إلى أقصى حد يسمح به القانون، يوافق المستخدم على تحمل المسؤولية عن المطالبات والخسائر والأضرار والتكاليف والمصاريف المعقولة الناشئة عن:
- مخالفته لهذه الشروط.
- انتهاكه لحقوق الغير.
- استخدامه غير القانوني للخدمة.
- المحتوى الذي يرفعه أو ينشئه أو يستخدمه أو ينشره.
- عدم حصوله على التصاريح أو الموافقات المطلوبة.
إلى أقصى حد يسمح به القانون، لا تتحمل Smart Pen App أو مالكوها أو مشغلوها أو موظفوها أو شركاؤها أو مزودو خدماتها المسؤولية عن أي:
- خسائر غير مباشرة.
- خسائر عرضية.
- خسائر تبعية.
- خسارة أرباح.
- خسارة فرص.
- خسارة أعمال.
- خسارة سمعة.
- فقد أو تلف بيانات.
- توقف أعمال.
- مطالبة من طرف ثالث.
ولا تتحمل Smart Pen App المسؤولية عن أي قرار أو إجراء يقوم به المستخدم اعتمادًا على نتائج الخدمة.
لا يسري أي استبعاد أو تحديد للمسؤولية بالقدر الذي يمنع القانون المطبق استبعاده أو تحديده.
المستخدم مسؤول عن قراءة هذه الشروط قبل استخدام الخدمة.
عدم قراءة الشروط لا يلغيها ولا يعفي المستخدم من الالتزام بها إلى أقصى حد يسمح به القانون.
إذا كانت الشروط متاحة بلغة لا يفهمها المستخدم، فإن استمرار المستخدم في تنزيل التطبيق أو دخوله أو استخدامه بعد إتاحة هذه الشروط يعني، إلى أقصى حد يسمح به القانون، أنه اختار الاستمرار على مسؤوليته وأنه مسؤول عن الحصول على ترجمة أو توضيح مناسب.
لا تتحمل Smart Pen App المسؤولية عن قرار المستخدم الاستمرار في الاستخدام دون قراءة الشروط أو فهمها، إلا بالقدر الذي يفرض فيه القانون التزامًا لا يجوز استبعاده.
قد تتوفر هذه الشروط بأكثر من لغة.
إذا حدث اختلاف في الصياغة بين الترجمات، فيجب تفسير النصوص بطريقة تحقق المعنى المقصود بأكبر قدر ممكن وبما لا يخالف القانون المطبق.
لا يقصد بأي ترجمة تقليل حقوق إلزامية يقررها القانون للمستخدم.
تم تصميم هذه الشروط للاستخدام الدولي.
يوافق المستخدم على الالتزام بجميع القوانين واللوائح والأنظمة التي تنطبق عليه في الدولة أو المنطقة التي يستخدم منها Smart Pen App.
ولا يقصد بهذه الشروط استبعاد أي حق أو حماية قانونية لا يسمح القانون المطبق بالتنازل عنها.
يجب على من لم يبلغ السن القانوني المطلوب لاستخدام الخدمة أو إبرام هذه الشروط الحصول على موافقة ولي الأمر أو الوصي حيثما يتطلب القانون ذلك.
يجوز لـ Smart Pen App تعديل هذه الشروط عند تطوير الخدمة أو تغير المتطلبات القانونية أو التقنية.
استمرار استخدام الخدمة بعد سريان التحديث يعتبر قبولًا به إلى أقصى حد يسمح به القانون، مع مراعاة الحالات التي تتطلب موافقة صريحة جديدة.
إذا اعتبر أي بند من هذه الشروط غير صالح أو غير قابل للتنفيذ في دولة أو ولاية قضائية معينة، فإن ذلك لا يؤثر على صلاحية بقية البنود، وتطبق بقية الشروط إلى أقصى حد يسمح به القانون.
تشكل هذه الشروط وسياسة الخصوصية وأي سياسات إضافية معروضة داخل Smart Pen App الاتفاق المنظم لاستخدام الخدمة.

These Terms govern access to and use of the Smart Pen App application, platform, websites, services, tools, and features.
By downloading, installing, accessing, creating an account, using any feature, submitting any request, or continuing to use Smart Pen App, you acknowledge that you have been given an opportunity to review these Terms and agree to be bound by them to the maximum extent permitted by the laws applicable to you.
Failure to read these Terms, failure to understand them, ignoring them, or using the application in a language you do not understand does not, to the maximum extent permitted by applicable law, excuse you from responsibility for your use of the service or from obligations and consequences arising from that use.
It is your responsibility to read the Terms and obtain a translation or clarification before using the service if you do not understand them.
Where the law applicable in a user's country requires separate affirmative consent or provides mandatory rights that cannot legally be waived, those requirements and rights remain applicable.
Downloading, installing, accessing, using, creating an account, or continuing to use Smart Pen App constitutes acceptance of these Terms and the Privacy Policy to the maximum extent permitted by applicable law.
If you do not agree, you must not use the service.
Smart Pen App is a technology platform offering digital tools and services that may include generation, analysis, editing, transformation, or processing of text, images, audio, video, documents, and files using artificial-intelligence technologies.
Smart Pen App provides technical tools and does not become the publisher, author, owner, or endorser of content submitted, requested, generated, selected, or used by a user merely because the service was used.
You are solely responsible for:
- All prompts, requests, and inputs.
- Images, text, audio, video, documents, and files you upload.
- Personal data or content relating to other people.
- Outputs you choose to generate.
- Content you download, save, modify, or retain.
- Content you publish, distribute, sell, or use commercially.
- Decisions you make based on outputs generated through the service.
Use of a Smart Pen App tool to create content does not transfer your responsibility to Smart Pen App.
You represent and warrant that you hold all rights, licenses, permissions, and consents necessary for any content you upload, submit, or process through Smart Pen App.
This includes, without limitation:
- Images.
- Faces and likenesses.
- Voices.
- Logos.
- Trademarks.
- Books.
- Text.
- Music.
- Video.
- Documents.
- Designs.
- Personal data.
- Other intellectual-property-protected materials.
Smart Pen App is not responsible for pre-verifying that you own or are authorized to use such materials.
Artificial-intelligence systems may produce information or content that is:
- Inaccurate.
- Incomplete.
- Unexpected.
- Similar to other existing content.
- Unsuitable for certain purposes.
- Unsuitable for particular legal or commercial uses.
Smart Pen App does not warrant that any output:
- Is 100% accurate.
- Is absolutely original or unique.
- Is free from third-party claims.
- Qualifies for intellectual-property protection.
- Is suitable for every commercial, legal, professional, or other use.
- Will exactly match user expectations.
You are responsible for reviewing every output before using it.
To the maximum extent permitted by applicable law, Smart Pen App is not responsible for:
- Misuse of the service.
- Illegal use of outputs by users.
- Intellectual-property infringement.
- Privacy, likeness, or voice-right violations.
- Impersonation.
- Misleading or manipulated content.
- Publication without required permission.
- Losses resulting from reliance on AI outputs.
- Disputes between a user and a third party concerning content.
- Business, educational, financial, legal, medical, professional, or other decisions made by a user based on outputs.
You must not use Smart Pen App for any activity that:
- Is unlawful.
- Is fraudulent.
- Violates the rights of others.
- Infringes intellectual-property rights.
- Violates privacy rights.
- Involves harmful impersonation or deceptive conduct.
- Involves extortion, threats, or harassment.
- Involves unlawful exploitation.
- Attempts to compromise, disrupt, or abuse the application.
- Circumvents security controls.
- Uses accounts or payment methods without authorization.
- Violates app-store or third-party-provider terms.
- Violates any binding law or regulation applicable to you.
To the maximum extent permitted by law, Smart Pen App may:
- Refuse a request.
- Remove or restrict access to content.
- Suspend an account.
- Restrict a feature.
- Discontinue a service.
- Terminate an account.
- Take security measures.
- Cooperate with competent authorities where legally required.
Smart Pen App and all services and outputs are provided “as is” and “as available.”
To the maximum extent permitted by applicable law, Smart Pen App makes no express or implied warranty that:
- The service will always be uninterrupted.
- The service will be completely error-free.
- Outputs will be accurate.
- Outputs will be fit for a particular purpose.
- All features will remain permanently available.
- Any third-party model or provider will remain available.
- Any output will be legally or commercially usable in every country.
Certain functionality depends on third-party providers.
Services may be affected by:
- Network outages.
- Third-party outages.
- API failures.
- Technical changes.
- Maintenance.
- App-store policy changes.
- Changes made by AI-model or infrastructure providers.
To the maximum extent permitted by applicable law, Smart Pen App is not responsible for failures or losses directly caused by events or third parties outside its reasonable control.
Smart Pen App outputs are not a substitute for qualified professional advice.
Outputs alone should not be treated as:
- Medical advice.
- Legal advice.
- Financial advice.
- Engineering advice.
- Licensed professional advice.
- Official educational or academic decisions.
You are responsible for verifying material information with an appropriately qualified professional.
You are responsible for complying with the rules of your school, university, employer, or educational institution.
Smart Pen App is not responsible for a user's use of the service for cheating, plagiarism, or violation of academic policies.
You are responsible for:
- Protecting your login credentials.
- Activity occurring through your account.
- Preventing unauthorized account sharing.
- Contacting support if unauthorized use is suspected.
Purchases may be processed through Apple, Google, or other payment providers.
Certain payment, cancellation, and refund matters may also be governed by the policies of the payment processor or app store and applicable law.
Credits or points may be consumed when processing begins, according to the service mechanism.
Submitting the same request more than once does not guarantee an identical output.
Smart Pen App does not guarantee that every generated output gives the user exclusive intellectual-property rights.
Different users may receive similar outputs.
You are responsible for verifying any rights required before publication, licensing, resale, or commercial use.
To the maximum extent permitted by applicable law, you agree to be responsible for claims, losses, damages, reasonable costs, and expenses arising from:
- Your breach of these Terms.
- Your infringement of third-party rights.
- Your unlawful use of the service.
- Content you upload, generate, use, publish, or distribute.
- Your failure to obtain required permissions or consents.
To the maximum extent permitted by applicable law, Smart Pen App and its owners, operators, employees, partners, and service providers will not be liable for:
- Indirect losses.
- Incidental losses.
- Consequential losses.
- Lost profits.
- Lost opportunities.
- Lost business.
- Reputational loss.
- Lost or damaged data.
- Business interruption.
- Third-party claims.
Smart Pen App is not responsible for any decision or action taken by a user in reliance on service outputs.
No exclusion or limitation applies to the extent that applicable law prohibits such exclusion or limitation.
You are responsible for reading these Terms before using the service.
Failure to read the Terms does not cancel them or excuse you from being bound by them to the maximum extent permitted by applicable law.
If the Terms are presented in a language you do not understand, continuing to download, access, or use the application after the Terms have been made available means, to the maximum extent permitted by applicable law, that you chose to continue at your own responsibility and that you are responsible for obtaining an appropriate translation or explanation.
Smart Pen App is not responsible for a user's decision to continue using the service without reading or understanding the Terms, except to the extent that applicable law imposes an obligation that cannot lawfully be excluded.
These Terms may be made available in more than one language.
If a difference in wording exists between translations, the versions should be interpreted in a manner that best preserves the intended meaning while complying with applicable law.
No translation is intended to reduce any mandatory legal rights available to the user.
These Terms are intended for international use.
You agree to comply with all laws, regulations, and legally binding rules applicable to you in the country or region from which you use Smart Pen App.
Nothing in these Terms is intended to exclude a right or legal protection that applicable law does not allow to be waived.
Anyone below the age legally required to use the service or enter into these Terms must obtain parental or guardian authorization where required by applicable law.
Smart Pen App may update these Terms to reflect changes in the service, technology, or applicable legal requirements.
Continued use after updated Terms take effect constitutes acceptance to the maximum extent permitted by applicable law, except where new express consent is legally required.
If any provision of these Terms is found invalid or unenforceable in a particular country or jurisdiction, that does not affect the remaining provisions, which remain effective to the maximum extent permitted by law.
These Terms, the Privacy Policy, and any additional policies displayed in Smart Pen App form the agreement governing use of the service.
